MICPEL - Elder Abuse and Neglect in the Community and in Long-Term Care
Attorneys and other professionals working with elder law unfortunately encounter elder abuse in the community and in long-term care facilities. To be effective advocates, these attorneys and professionals need to know how to identify the signs of abuse and the available resources that assist in stopping and preventing future abuse.
This course covers issues such as abuse and neglect in the community and the resources available to protect and defend clients. The resources discussed include using the Ombudsman from the local Department of Aging, reporting and investigating of abuse in long-term care facilities by the Office of Health Care Quality, prosecuting nursing home negligence and offenders of both physical and financial abuse, and using the powers of attorney and forced transfer.
Attorneys and other professionals dealing with the elderly and disabled gain practical understanding to help and better serve their clients' needs.
The course is based on materials and a live presentation from Elder Abuse and Neglect in the Community and in Long-Term Care Facilities, which was originally presented on Nov. 1, 2007.

- Understand state and federal regulations that affect long-term care facilities and how these agencies works to curb patient abuse
- Learn to evaluate, investigate, prepare and win nursing home negligence cases
- Discover how to best investigate a case, prepare for proving damages, and win standard of care issues
- Evaluate the importance of documentary evidence in a nursing home neglect case and learn how to use those records to prove your case
- Explore the ongoing problems in facilities and how attorneys deal with certain problems associated with their cases
- Review the role of Maryland's Adult Protective Services
- Study neglect and self-neglect elder abuse issues in the community
- Learn about Maryland's long-term care Ombudsman program - its history and role of local Ombudsmen
- Understand the intricacies of litigation involving financial abuse and exploitation of vulnerable adults, abuse of joint ownership of property and powers of attorney
- Discover how cases of neglect and abuse in nursing homes and assisted living facilities are investigated and prosecuted by the Medicaid Fraud Unit of the Maryland Attorney General's Office
- Gain an understanding of how physical and financial abuse crimes of vulnerable adults are prosecuted by the local state's Attorneys Office.
